Terms of Service
These terms are an agreement between you and Tem Ab, the individual developer of Flowerbook ("we", "us"). They cover the Flowerbook app for iPhone (previously named Walk Flower) and the website walkflower.com (the "Service"). By downloading or using the Service, you agree to these terms and to our Privacy Policy. If you don't agree, don't use the Service.
1. Eligibility
You must be at least 13 years old to use Flowerbook. If you are under the age of majority where you live, you may use the Service only with the permission of a parent or guardian, who agrees to these terms for you and is responsible for your purchases.
2. Your account
The app creates an anonymous account for you automatically. You can sign in with Apple, Google or a phone number to keep your flowers across devices. An anonymous account is tied to the app on your device: if you delete the app before signing in, your account and flowers can't be recovered.
Your journal, including notes and photos, is stored on your device. Deleting the app deletes it, unless you have Plus and have turned on the notes backup (photos are never backed up). Keep your own copies of anything you can't afford to lose.
You're responsible for activity on your account and for keeping access to your sign-in method. Use one account per person, and don't sell, share or transfer your account.
3. Health and step counts
Flowerbook is a motivational step counter and journal, not a medical device. It doesn't give medical advice. Step counts and walking statistics come from your iPhone's sensors and Apple Health, and they may be inaccurate. Talk to a doctor before starting a new exercise routine. Pay attention to your surroundings while walking, and don't use the app where doing so is unsafe.
Any step totals the Service shows for other people are the totals their devices reported. We don't guarantee that anyone's totals or streaks are accurate.
4. Your content
Your journal notes and photos, and your display name, @username and profile photo, are "your content". You keep ownership of your content. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy and display it, only to operate and improve the Service: for your journal, that means keeping the notes backup if you turn it on and giving it back to you; for your profile, showing it as described in the Privacy Policy. This license ends when your content is deleted, except for copies other users have already received or that we must keep by law.
You confirm that you have the right to use your content and that it follows section 5. Your journal is private to you. Your profile may be visible to other users as described in the Privacy Policy.
5. Acceptable use
We have zero tolerance for objectionable content or abusive users. You agree not to:
- post, in any part of the Service other people can see, content that is unlawful, hateful, harassing, threatening, sexually explicit, violent, or that impersonates someone or infringes anyone's rights;
- bully, harass or spam other users, or misuse invitations;
- fake step counts, exploit bugs, or use bots, scripts or modified clients to earn flowers, Plus features or anything else;
- access or collect other users' data, or access the Service other than through the app and website;
- interfere with, overload, or try to break the security of the Service;
- copy, modify, reverse engineer or resell the app or its artwork, except as the law allows.
To report content or a user, email gas.app.developers@gmail.com with their @username and what happened. You can also mute or remove people yourself in the app. We review reports within 24 hours. We may remove content and suspend or ban accounts that break these terms, with or without notice.
6. Flowerbook Plus
Flowerbook Plus is an optional auto-renewing subscription, available weekly, monthly or yearly. It adds extras on top of the free app, such as the Plus weekly flower sets, swapping the week's choices, bringing back a missed flower, the notes backup and deeper walking statistics. Every flower stays free for everyone. The current prices and features are shown in the app before you subscribe, and we may change them.
- Payment is charged to your Apple ID when you confirm the purchase, or when a free trial ends if one is offered.
- Your subscription renews automatically at the same price and period unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the period ends.
- You can manage or cancel your subscription in your Apple ID settings. Cancelling stops the next renewal, and Plus stays active until the end of the period you've paid for.
- If you subscribe during a free trial, any unused part of the trial ends when you subscribe.
- When Plus ends, you keep every flower you collected and everything in your journal. Plus features stop, and the notes backup stops updating; the copy already on our servers stays until you turn the backup off or delete your profile as described in the Privacy Policy.
- All purchases are final, except as required by law or Apple's refund policies. To ask for a refund, go to reportaproblem.apple.com.
We may also grant Plus time for free, for example through a promotion. Granted time is a courtesy, has no cash value and can't be transferred or refunded.
7. Earlier versions: tokens and cosmetic items
Earlier versions of the app had Walkflower tokens and cosmetic card items. The current app doesn't use them. Any balance or items left on your account have no cash value, can't be exchanged for money or anything outside the Service, and aren't refunded. If an older version of the app still shows them, the terms that applied to that version continue to apply to it.
8. Our intellectual property
The app, website, flower artwork, designs, names and logos belong to us or our licensors and are protected by law. We give you a limited, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, as allowed by Apple's Usage Rules. Collecting a flower doesn't give you any right to its artwork outside the Service. If you send us ideas or feedback, we may use them freely, without paying you.
9. Changes to the Service
Flowerbook changes every week: flower sets and features come and go. We may modify, suspend or stop any part of the Service at any time. If we shut down the Service entirely, we'll give reasonable notice in the app where we can.
10. Ending your use
You can stop using the Service at any time and delete your profile in Settings → Account Management. See the Privacy Policy for what's deleted. We may suspend or end your access if you break these terms or if we have to by law. Sections 4 (license for content already shared), 7, 8 and 11–15 survive termination.
11. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied. This includes merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise that the Service will be uninterrupted, error-free or secure, or that data or progress, your journal and its backup included, will never be lost.
12. Limitation of liability
To the fullest extent the law allows, we're not liable for any indirect, incidental, special, consequential or punitive damages. This includes lost profits, lost data, lost notes, photos or flowers, and personal injury from physical activity. Our total liability for any claim related to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US $50.
Some jurisdictions don't allow some of these limits. Where that's the case, they apply only as far as the law allows. Nothing in these terms limits your rights as a consumer under the mandatory laws of the country where you live.
13. Indemnity
You agree to cover our losses and costs, including reasonable legal fees, that result from your content or your breach of these terms, to the extent the law allows.
14. Governing law and disputes
These terms are governed by the laws of the United States, without regard to conflict-of-law rules. If you have a problem, please contact us first: most issues can be solved by email. If you live in the EU, the UK or another country with mandatory consumer laws, you keep the protection of those laws and can bring claims in your local courts.
15. Apple App Store terms
If you got the app from the Apple App Store:
- These terms are between you and us, not Apple. We, not Apple, are solely responsible for the app and its content.
- Your license to use the app is limited to Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- We alone are responsible for maintenance and support. Apple has no obligation to provide any.
- If the app doesn't conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the maximum extent the law allows, Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for any claims about the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
- If a third party claims that the app infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging the claim.
- You confirm that you're not located in a country subject to a US Government embargo or designated as "terrorist supporting", and that you're not on any US Government list of prohibited or restricted parties.
- You must comply with any third-party terms that apply when you use the app, such as your mobile carrier's.
- Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right to enforce them against you.
Where these terms don't cover something, Apple's Licensed Application End User License Agreement applies.
16. Changes to these terms
We may update these terms. We'll change the date at the top, and we'll tell you in the app about material changes before they take effect. If you keep using the Service after changes take effect, you accept the new terms.
